Terms and conditions
These general terms and conditions govern the relationship between members and/or customers of Not A Cliche OOD by clicking on an object, picture, link (different from the General Terms and Conditions) or button located on the website: https://notacliche.bg/ considers that you accept or agree to the General Terms and Conditions described below.
1. Definitions
Notacliche - Not A Cliche OOD , EIK 204480004 , address of management: Republic of Bulgaria, Gr. Blagoevgrad, str. Aleko Konstantinov 4 , E-Mail: notacliche.ltd@gmail.com
Website – https://notacliche.bg/, and their sub-domains, including but not limited to the public website
Partners – commercial companies with which Notacliche has concluded contracts for the sale of discount coupons for the use of the services and/or products provided in the respective commercial establishments.
Coupon (Voucher) – a discount document issued by the Partner and sold by Notacliche through the website to members and/or customers, which is valid for the period specified in it and applies to the services and/or products specified in it.
Check - a discount document issued by Notacliche, which is valid for the period specified in it, as a preference for loyal members.
Content has the following definition:
All information on the Website that can be viewed through the use of an electronic device; The content of all emails sent to the USER and CLIENT by Notacliche through electronic means and/or any other means of communication;
Any other information to a USER or CUSTOMER received by an employee of Notacliche, regardless of the method of communication;
Information relating to products, services and/or fees applied by Notacliche in a given period;
Information related to products, services and/or fees applied by third parties with whom Notacliche has an established partnership during a certain period;
Information relating to Notacliche or any information sourced from Notacliche.
Service - Electronic commercial service performed on the publicly accessible parts of the Internet page, with the aim of providing the customer with the opportunity to purchase products and/or services, including the purchase of coupons (vouchers), using only electronic means, including means of distance communication (e.g. standard letter, internet, e-mail, etc.).
Member – a natural person owning or gaining access to the CONTENT, through any means of communication (electronic, telephone, etc.) or based on the use of an agreement between Notacliche and third parties, which requires the creation and use of a PROFILE.
Profile – an element consisting of an e-mail address and a password, which allow only one MEMBER to access limited parts of the Internet page and through which the SERVICES are accessible.
Customer – a natural person who owns or acquires access to the CONTENT or SERVICES after the creation of a MEMBERSHIP PROFILE.
Document - these general terms and conditions.
Distance sales contract - any contract concluded on the basis of an offer
by the provider Notacliche to the user as part of a system for the sale of goods or the provision of services, including the purchase of vouchers (coupons), where from the date of the proposal until the conclusion of the contract, the parties are not in physical contact with each other.
Brochure/announcements/messages – currently informational means, mainly electronic, concerning products, services in the commercial outlets of the partners, including the purchase of vouchers (coupons), or promotions offered by Notacliche in a certain period of time, without binding Notacliche to the provided information.
Transaction - collection or refund of funds resulting from the sale of a product or service, including the service of purchasing vouchers (coupons), by Notacliche to the CLIENT.
1.1. Definitions of product labels/stickers
EXCLUSIVE - Product for which no codes or seasonal discounts apply.
NEW - New product.
PRE ORDER - A product that is pre-ordered and not currently available. In the description of the product itself with this sticker you can find the exact date of expected delivery of the item.

General applications
This Document defines the general conditions under which a Member or Client may use the Website / Content / Services, in the event that there is no other valid agreement between Notacliche and the Member/Client.
2.2. Use, including but not limited to accessing, visiting and viewing Content / Services, assumes that the Member or Customer adheres to these General Terms and Conditions, except in cases where the given content has specific conditions mentioned.
2.3. Access to the Services is possible only and exclusively through the publicly accessible Internet pages https://notacliche.bg/
2.4. By using the Website / Content / Services, the MEMBER or CLIENT is solely responsible for all consequences arising from this use. In addition, the MEMBER or CLIENT is responsible for any property, intellectual or electronic or any other damage caused to the Website / Content / Services, Notacliche or any other person with whom Notacliche has a contract for joint activity or for the provision of services according to Bulgarian legislation.
2.5. If the Member or Customer does not agree and/or does not accept and/or revoke his/her consent to this document:
2.5.1. He/She waives: access to the Services; other Services that Notacliche offers through its Website; the receipt of Brochures / Notices or other communication from Notacliche (electronic, telephone, etc.) without any further warranty from Notacliche.
2.5.2. Notacliche will delete all personal information from its database without any subsequent obligation from either party to the other and without either party being liable for damages to the other.
2.5.3. It may at any time change its decision to accept or reject this document as it is available at the time of the decision.
2.6. The Customer / Member may at any time agree to and accept the document as it is available at that time.
2.7. In order to exercise the right described in Art. 2.5, The Member / Customer may connect to Notacliche or use the internet connections provided by Notacliche for this purpose.
2.8. The customer may not retroactively withdraw its consent to this document while the contractual relationship is in force or until it has paid all contractually owed funds to Notacliche.
2.9. If the Customer has paid all funds owed to Notacliche and withdraws consent to this document at the time of placing an Order, Notacliche will terminate the order without the occurrence of additional obligations and without any of the parties being liable for any resulting damages.
2.10. The website is addressed only to Members and Customers who are duly registered and have not been rejected by Notacliche for any reason. The possibility of ordering via the Internet is available only to Members with a residence in Bulgaria. Persons under the age of 18 do not have the right to use the Website / Content / Services, make statements and enter into contracts within the meaning of these General Terms and Conditions. By registering on the website and creating a Profile, the person declares that he is of legal age (over 18). -
Content
3.1. All content, including but not limited to static images, dynamic images, text and/or multimedia content published on the Website is the property of Notacliche or third parties, in which case the content may be accompanied by a mention of its ownership, for which Notacliche has permission to use.
3.2. The Member or the Client may not copy, transfer, modify or otherwise make changes, use, link to, expose, include any Content in another context, outside of Notacliche, including any content from the Website outside of Notacliche, removing images, brands, distribution of materials prepared for reproduction, modification or display of content without the express consent of Notacliche.
3.3. Any Content to which a Member or Customer has or receives access is protected by the Document, unless the content is accompanied by a specific and duly executed consent for use between Notacliche and the Member or Customer or another party, or there is no express reference by Notacliche to the content in question for its use.
3.4. A Member or Customer may copy, transfer and/or use the content only for their own personal and non-commercial purposes, but only if they do not conflict with the provisions of the Document.
3.5. If Notacliche grants a Member or Customer the right to use Content pursuant to a separate agreement to which the Member / Customer has or acquires access that differs from that described in this document, the right extends only to the content defined in the agreement, only while the content is available on the Internet page or within the period agreed in the agreement according to the conditions mentioned in the agreement only in the event that it exists and does not constitute confidential information given by Notacliche to the given Member, Customer or other third parties who have / gain access to the transferred content in any way, which access may be withdrawn in any way during or after the expiration of the usage agreement.
3.6. No Content transferred to a Member or Customer through any communication channels (electronic, telephone, etc.) or acquired by a Member or Customer by accessing, visiting or viewing it shall create a contractual obligation for Notacliche and/or Notacliche's employee , who made the transfer of the content in cases where it is known and related to the given content.
3.7. Any use of the Content for purposes other than those expressly set forth in this document or any accompanying document, if any, is prohibited. -
Contact
4.1. Notacliche shall publish on the Website its full and accurate identification details as well as its Member or Customer contact details.
4.2. By using the contact form provided on the Website, the Member or Customer allows Notacliche to contact him by any means available, including electronically.
4.3. Partial or full completion of the contact form does not obligate Notacliche to contact the Member or Customer in return.
4.4. Access to the website, use of the information presented, visiting its pages or sending e-mail notifications addressed to Notacliche is done electronically, by telephone or other means available to the Member or the Client, which constitutes a presumption that the Member or the Client agrees to receive notices from Notacliche electronically and/or by telephone, including e-mail communication or notices on the Website.
4.5. Notacliche reserves the right not to respond to all requests of any kind, received by any means (electronic way, telephone, etc.). -
Brochures, notices and announcements
5.1. When a Member or Customer creates a Profile on the Website, accepting the Terms and Conditions, by default also agrees to receive Brochures and/or Notices from Notacliche. -
Card payment terms
When choosing a card payment method:
• A payment page of our service bank (OBB) opens, where you enter your card data (number, validity, security code, name)
• If you are registered in the Verified by VISA or MasterCard SecureCode authentication schemes, an authentication page of your Issuing bank opens, where you enter your authentication password
• In case of a successful transaction (successful authentication and authorization), a transaction note is displayed on the screen, which you print or save.
Please note that your V PAY or MasterCard Electronic card will only be accepted if it is registered to participate in the Verified by Visa or MasterCard SecureCode online authentication schemes.
Note A Cliché Ltd. makes every effort to provide reliable protection for its e-shop. To protect you from abuse when paying with your Visa or MasterCard card, we apply the best practices recommended by international card organizations:
• Security when entering and transferring card data is ensured by using the SSL protocol to encrypt the connection between our server and the payment page of our serving bank
• The authenticity of your card is verified by entering a security code (CVV2)
• In addition, to identify you as a cardholder, the e-commerce payment server of our servicing bank supports the authentication schemes of the international card organizations - Verified by VISA and MasterCard SecureCode, in case you are registered to use them.
If it is necessary to return sums paid by card for services agreed and performed by us, this will be done by us through a credit transaction on the card with which the payment was made.
• The maximum amount for a transaction is BGN 10,000.
• The transaction currency when paying by card is Bulgarian lev (LV).
• Payment for goods and delivery is made by the following credit or debit cards: VISA, VISA Electron, V PAY, MasterCard, Maestro and MasterCard Electronic, as well as cash on delivery, if the Customer has selected the relevant option and it is available for the relevant payment. -
Payment Data Protection Policy
• Note A Cliche Ltd. makes every effort to provide reliable protection for its e-shop. To protect you from abuse when paying with your Visa or MasterCard card, we apply the best practices recommended by international card organizations:
• Security when entering and transferring card data is ensured by using the SSL protocol to encrypt the connection between our server and the payment page of our serving bank
• Payment is made on the payment page of our service bank and we do not have access to your card details, therefore we do not store them on our server
